SECTION 2 - SCOPE OF APPLICATION & SUBJECT MATTER OF THE CONTRACT
Our General Terms and Conditions (abbreviated: “GTC”) apply to all orders placed through our shop www.ev-doc.de and govern the resulting business relationship between the customer (hereinafter: “You”) and EV-DOC (hereinafter: “We”). Only the version applicable at the time the order is placed shall apply. It can be viewed at any time in German at https://ev-doc.de/policies/terms-of-service.
SECTION 3 - CONCLUSION OF THE CONTRACT
The products offered on EV-DOC generally do not constitute a binding offer. Rather, our shop is to be understood as a digital catalogue. You can select products from our range and collect them in a so-called shopping-cart order system by clicking the shopping-cart button “Add to cart”. You submit a binding contractual offer to us only when you place the order. This is done by clicking “Buy now” at the end of the ordering process. The terms and conditions displayed when the order is placed shall apply. We will then send you an order confirmation by email, whereby the purchase contract is concluded.
SECTION 4 - PRICES, SHIPPING COSTS, PAYMENT, RETENTION OF TITLE
The stated price of all products offered on EV-DOC, as well as their packaging, includes the applicable statutory value-added tax.
Only shipping costs are charged additionally. These can either be viewed under Shipping or calculated directly in the shopping cart based on the products and the respective delivery address. Please note that any import duties incurred in your country are neither controlled nor levied by us and are therefore not included in the shipping costs.
You can choose from the following payment methods:
- Apple Pay, Google Pay,
- PayPal,
- Credit card (VISA, MasterCard, American Express, UnionPay),
- Klarna Sofortüberweisung, eps bank transfer, Bancontact, iDEAL.
The delivered goods shall remain our property until full payment has been made.
SECTION 5 – DELIVERY
After we accept the order, the goods you ordered will be immediately shipped to the delivery address you provided.
If we are unable to ship your order due to the fault of third parties, we shall be entitled to withdraw from the contract. In this case, we will inform you immediately and refund all payments made by you.
The same applies to unforeseeable events such as natural disasters, for example.
SECTION 6 – TRANSPORT DAMAGE
Our goods are delivered by parcel delivery services. If you notice any externally visible damage to the packaging when the shipment is handed over to you, you can have it documented directly with the delivery driver. Alternatively, you may refuse acceptance, in which case the shipment will be returned to us. In any event, however, we expressly ask you to inform us immediately of any possible damage so that we can support you in the matter as quickly as possible and assert any potential claims against the parcel delivery service responsible for carrying out the delivery.
Please note that the above provisions do not restrict your statutory rights, but are a request on our part that makes it easier for us to handle transport damage.
SECTION 7 – WARRANTY, GUARANTEE, INSTALLATION NOTICE
The products offered on EV-DOC are covered by the statutory 2-year warranty.
In the case of obvious defects, we ask you to notify us of these in writing immediately after receiving the goods so that we can respond as quickly as possible.
If a warranty claim exists, you may choose between having the product repaired or receiving a replacement delivery. However, if one of these options would incur disproportionately high costs, we reserve the right to exclude it. We will inform you of this promptly.
A guarantee exists for the goods delivered by us only if it was expressly provided in the item description for the respective item.
We point out that the installation of passenger car parts and accessories must be carried out professionally. EV-DOC does not provide any advisory services, meaning that you are solely responsible for ordering the part suitable for your vehicle in order to avoid the operating permit expiring. Without an operating permit or registration in accordance with the German Road Traffic Licensing Regulations (StVZO), motor vehicles may not be driven or used within the scope of application of the StVZO.
SECTION 8 – LIABILITY
The statutory liability provisions shall apply.
SECTION 9 – DUTY TO INSPECT
At EV-DOC, we handle all orders with the utmost care. Nevertheless, incorrect deliveries may occur in individual cases. You are therefore obliged to compare the spare parts delivered by us with the original part before installation with regard to the part number, dimensions and/or connections. If you have any doubts about the fit, please contact us before installation. This is the only way we can verify whether the spare part you purchased fits correctly.
Your statutory warranty claims shall remain unaffected by this.
SECTION 10 – CONSUMER DISPUTE RESOLUTION
The European Commission provides a platform for online dispute resolution (abbreviated: ODR). You can find it here: http://ec.europa.eu/consumers/odr.
We do not participate in dispute resolution proceedings before a consumer arbitration board.
SECTION 11 – DATA PROTECTION
We process your personal data for specified purposes and in accordance with the statutory provisions of the GDPR and the BDSG.
For further information, please refer to the Privacy Policy.
SECTION 12 – APPLICABLE LAW, CONTRACT TEXT & PLACE OF JURISDICTION
German law shall apply to this contract, excluding the UN Convention on Contracts for the International Sale of Goods. However, this choice shall apply to you only insofar as it does not conflict with mandatory consumer protection provisions in the country in which you have your principal residence.
We do not store the contract text. However, you can view and print our General Terms and Conditions at any time in our online shop.
For any disputes in connection with this contract, the place of jurisdiction shall be Berlin, insofar as you act as an entrepreneur within the meaning of Section 14 of the German Civil Code (BGB).
